1. Introduction

The Platform is owned and operated by Kortya Finance Pvt. Ltd., incorporated under the Companies Act, 2013, having its registered office at Kota, Rajasthan (“KortyaPay”, “Company”, “We”, “Us”).

These Terms govern access to and use of all services including payments, prepaid instruments, lending facilitation, international payments, and travel bookings.

2. Legal Nature of Agreement

These Terms constitute a legally binding electronic agreement under the Information Technology Act, 2000. By using the Platform, you agree to be bound by these Terms.

3.1 Payment & Utility Services

• AEPS transactions
• BBPS bill payments
• FASTag recharge
• Domestic money transfers

3.2 Prepaid & Card Services

• Prepaid cards & co-branded cards
• Gift cards

3.3 Payment Gateway & Orchestration

• Merchant payment gateway
• API-based integrations

3.4 International Payments

Cross-border payments via authorized partners.

3.5 Lending Services (LSP)

KortyaPay facilitates small-ticket loans as a Loan Service Provider (LSP) in partnership with RBI-regulated banks and NBFCs.

3.6 Travel Services

Travel bookings through third-party providers.

4. Role & Regulatory Positioning

KortyaPay acts solely as a technology facilitator. Payment and lending services are governed by RBI, NPCI, and partner bank rules.

5. User Eligibility

• Minimum age: 18 years
• Valid KYC documents
• Legally competent under Indian law

6. Registration & Account Responsibility

Users are responsible for safeguarding login credentials and all activities performed through their account.

7. Consent & Data Usage

By using the Platform, users consent to data processing, KYC checks, credit bureau checks, and regulatory reporting.

8. Fees & Charges

Applicable fees are disclosed prior to service usage. No hidden charges are levied by KortyaPay.

9. EMI, Repayments & Loan Disclosure

• EMI schedules are transparent
• Payments go directly to lenders
• Delays may attract penalties

10. Prohibited Use

Users shall not engage in unlawful, fraudulent, or prohibited activities or attempt unauthorized system access.

11. Third-Party Services

Certain services are provided by third-party partners. KortyaPay is not responsible beyond its facilitation role.

12. Intellectual Property

All intellectual property belongs to KortyaPay or its licensors.

13. Suspension & Termination

Access may be suspended or terminated for regulatory, fraud, or compliance reasons.

14. Limitation of Liability

KortyaPay shall not be liable for lender decisions, partner failures, or indirect losses to the extent permitted by law.

16. Governing Law & Jurisdiction

These Terms are governed by Indian law. Courts at Rajasthan shall have exclusive jurisdiction.

17. Amendments

KortyaPay may amend these Terms as required by law or operations. Continued use constitutes acceptance.
